In these Terms, “Viva’s”, “we”, “us” and “our” refer to Viva's spletna trgovina Živa Ferlež s.p.
By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Return and Refund Policy and Shipping Policy.
Nothing in these Terms limits any mandatory rights you have under applicable consumer protection law.
Viva’s sells leather bags, accessories and related products through vivasbags.com.
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services.
You may browse the website without creating a customer account.
You must provide accurate, current and complete information when placing an order. You are responsible for keeping any customer account credentials confidential.
To place an order, you generally:
select a product and any available options;
add the product to your cart;
proceed to checkout;
provide the required billing, delivery and contact information;
select an available shipping and payment method;
review your order; and
submit the order.
Before submitting your order, you can review and correct the information entered through the cart and checkout process.
Submitting an order constitutes an offer to purchase the selected products.
The sales contract is concluded when we send you an order confirmation confirming acceptance of your order.

Contracts may be concluded in English or Slovenian depending on the language version of the store you use.
All orders are subject to product availability.

payment cannot be authorised or processed;
we identify suspected fraud or misuse;
an obvious pricing or product information error has occurred; or
we are unable to deliver to the requested destination.
If we cancel an order after payment has been received, we will refund the amount paid.
We may limit quantities where reasonably necessary, including for products made in limited quantities.
We make reasonable efforts to describe and photograph our products accurately.
Colours may appear slightly different depending on the screen, device or display settings used.
Leather is a natural material. Variations in grain, texture, markings and tone may occur between individual pieces and are part of the natural character of the material.
Natural variations that are consistent with the nature of the leather are not in themselves considered defects or lack of conformity.
This does not limit your statutory rights where a product is defective or otherwise does not conform to the sales contract.
Prices displayed in our online store are shown in euros unless another currency is expressly displayed.
Prices include VAT where applicable.
Shipping charges, where applicable, are displayed separately before you submit your order.
For deliveries outside the European Union, local customs duties, import taxes or other charges may be imposed by the destination country. Unless expressly stated otherwise during checkout, these charges are not included in the purchase price and are the responsibility of the recipient.
Prices and promotions may change from time to time. The price applicable to your purchase is the price displayed when your order is submitted and confirmed.

Payment is processed through Shopify and/or the payment service providers made available at checkout.
You confirm that you are authorised to use the payment method selected for your purchase.
We do not generally receive or store complete payment card details.
Available shipping methods, shipping costs and estimated delivery times are displayed on our website or during checkout.
Delivery times are estimates unless we expressly agree otherwise.
We are not responsible for delays caused by circumstances outside our reasonable control, such as customs procedures, carrier disruptions, severe weather or other exceptional events. This does not affect any mandatory rights you may have under applicable law.
For consumer purchases, the risk of loss or damage generally remains with Viva’s until you or a third party designated by you, other than the carrier, physically receives the goods.
If you independently arrange delivery with a carrier that was not offered by us, risk may pass when the goods are handed to that carrier, as provided by applicable law.

Consumers purchasing online generally have the right to withdraw from the contract within 14 days of receiving the goods, without giving a reason, subject to applicable legal exceptions.
To exercise this right, you must notify us within the applicable period.
For standard returns due to a change of mind, the customer is responsible for the direct cost of returning the goods.

Nothing in these Terms or our Return and Refund Policy limits your statutory consumer rights.
We are responsible for products that do not conform to the sales contract in accordance with applicable consumer protection law.
For consumer purchases governed by Slovenian law, the seller is responsible for a lack of conformity that exists at the time of delivery and becomes apparent within two years of delivery.

Depending on the circumstances and applicable law, you may be entitled to repair, replacement, a reduction in price or termination of the sales contract and refund.

Viva’s may offer repair services for certain products, including repairs relating to stitching, edge finishing or hardware.
Availability, feasibility, timing and any applicable cost depend on the condition and type of product.

Any voluntary repair service offered by Viva’s is separate from and does not reduce statutory rights you may have in relation to defective or non-conforming goods.
The content of vivasbags.com, including the Viva’s name, branding, logos, product designs, photographs, text, graphics, videos and other original material, is owned by Viva’s or used with permission from the relevant rights holder and is protected by applicable intellectual property laws.
The website and its content may be used for personal, non-commercial purposes.
You may not reproduce, distribute, modify, commercially exploit or otherwise use our protected content without our prior permission, except where permitted by applicable law.
You may not use our website:
for unlawful or fraudulent purposes;

To the extent permitted by applicable law, we are not responsible for indirect or unforeseeable losses that are not a reasonably foreseeable consequence of our breach.
We are not responsible for a delay or failure to perform an obligation where it is caused by circumstances outside our reasonable control.
Where such circumstances materially affect an order, we will take reasonable steps to inform you and minimise the effects of the delay.
Your mandatory consumer rights remain unaffected.

The version that applies to a purchase is the version in force when the relevant order is placed.

These Terms and contracts concluded through our online store are governed by the laws of the Republic of Slovenia.
If you are a consumer who normally resides in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the laws of your country of residence.

Viva’s does not currently recognise any provider of out-of-court consumer dispute resolution as competent to resolve consumer disputes that a consumer may initiate under the Slovenian Out-of-Court Resolution of Consumer Disputes Act (ZIsRPS), except where participation is required by applicable law.
If we reject a consumer complaint, we will provide the information concerning available out-of-court dispute resolution options required by applicable law.
